Feds file child porn charges against Lexington man

LEXINGTON — A Lexington man is in the custody of the U.S. Marshals following his arrest at an Otterbein Drive residence. He is accused of receiving and distributing child pornography on a computer.

Peter J. Schmidt, age unavailable, of 179 Otterbein Drive, was arrested June 6 at his sister’s home, according to court records. The residence was searched and evidence obtained, which included a CD containing child pornography.

He is being held without bail by federal officials.

Schmidt’s Cleveland attorney, John B. Gibbons, declined comment Thursday.

According to a federal arrest warrant, Schmidt knowingly received and distributed child pornography that had been shipped or transported in or affecting interstate or foreign commerce by any means, including by computer.

A voluntary interview was conducted with Schmidt on June 4, court records state. During the course of the interview Schmidt admitted to using the username RckyMtnHigh on one pornographic website and the username oh_9in_ip on Yahoo Messenger. He also admitted to receiving and transmitting images of children engaged in sexually explicit conduct via Yahoo Messenger.

Lexington police arrested Schmidt and he was initially held on a $1 million bond in Mansfield Municipal Court, according to court records.

That case was dismissed locally and then refiled by federal authorities.

Schmidt appeared in federal court June 6 in Cleveland before Judge Greg White. He waived his preliminary hearing and the case was bound over to the grand jury for further proceedings.

According to court records, including an affidavit filed by a special agent of the FBI, on March 11, an FBI Washington Field Office task force officer working undercover chatted with an individual on a pornographic website, in the “Barely Legal” chat room. Authorities said that is a predicated chat room that has led to numerous arrests for child pornography violations in the past.

The affidavit details information about the images of nude prepubescent females that were transmitted to the undercover agent. The undercover agent stated he had received five images queried through the National Center for Missing and Exploited Children Child Victim Identification Program Internet portal. The return showed a girl who was a known child victim, according to the affidavit.

The undercover agent sent a subpoena to Embarq/CenturyLink requesting customer information associated with the use of the IP address during the time of the communications. The account was listed in Schmidt’s sister’s name.

    WE see this happening a lot the people that are looking at the porn are going to jail…but the web sites are never busted … why don’t they go after the people that are actually taking these photos and profiting…..if they can track a person down that’s watching …it seems like they could find the source…

      More than likely ran by the Feds, and now that we know they are watching, who’s to say they can’t plant the stuff on those they want silenced for one reason or another? Having a CD not on a computer would make great evidence, but if they are relying on what’s on a stand alone pc I would think a good Attorney could prove reasonable doubt knowing a whistle blower has made us aware of what they can and will do with our personal information. This story will surely be interesting to follow, can’t wait to hear the outcome. 🙂
